Subscription Terms

 

1. Subscription agreement

These Subscription Terms are accepted by the customer (“Customer”), when concluding an agreement on SIM Card Data subscription service (“Subscription”) including access to a login portal via www.marine1alarm.com, with the Danish company Dynamic Seasafe Technology ApS.

The applied language of the Subscriptions is English.

2. Prices

All prices are in EUR including VAT. Depending on the applicable payment method, further costs may occur.

3. Payment

A Subscription is concluded and final, upon the Customers receipt of an order confirmation from Dynamic Seasafe Technology ApS (“Date of Acceptance”).

The Customer can choose to perform payment by Debit card, Maestro, MasterCard or VISA.

The Subscription is prepaid monthly or yearly (to be choosen upon purchase). When concluding the Subscription, the Customer accepts that Dynamic Seasafe Technology ApS from the account provided by the Customer withdraws a monthly (or yearly) fee, until the Subscription is terminated. The hardware and software cannot function without a subscription plan purchased from Dynamic Seasafe Technology ApS on www.marine1Alarm.com

4. Period of commitment

The subscription begins when an order is placed and successfully paid. From that moment a grace period of 14 days begins, to allow for shipping, installation and tryout. After 14 days, charged period begins.

The minimum period of commitment is six months from the Date of Acceptance in which period the Subscription cannot be terminated.

The Subscription continues after the minimum period of commitment, unless it is terminated in accordance with clause 9.

5. Cancellation rights

A consumer customer has the right to cancel the Subscription after receiving the products.

To utilise the cancellation right, the customer must complete and send the cancellation form received as an attachment to the order confirmation. The form must be sent to info@Marine1Alarm.com before the expiry of 14 calendar days after the Date of Acceptance.

When the cancellation is received, all payments will be transferred to the Customer as soon as possible. The funds will be returned by the same method as the initial payment, unless the Customer explicitly requests differently.

6. Non-conformity and notification

In case of defaults, the Customer must notify Dynamic Seasafe Technology ApS within timely manner, including proof of the Subscription such as an order confirmation or an invoice.

The Customer acknowledge that the Subscription is on software and thus accepts that short periods of outage time is to be expected and thus not a default.

7. Termination and notice

At the end of the period of commitment, cf. clause 4, the Subscription may be terminated with a notice of months plus 30 days.

If the Customer terminates the Subscription earlier, the Subscription will terminate automatically six months after the Date of Acceptance.   

As payment is prepaid on a monthly or yearly basis, any prepaid fee will be transferred to the Customer, if the Customer terminates and said prepaid fee relates to time after the notice of termination.

A termination notice is not valid, unless it is sent to: info@Marine1Alarm.com.

8. Liability

Dynamic Seasafe Technology ApS is under no circumstances liable for indirect, special, consequential or incidental damages or losses, including but not limited to operating losses, loss of profits, loss of time, potential income from chartering, leasing of boat, passenger transportation, cargo transportation, whether claimed in contract, warranty, product liability, tort (including negligence) or otherwise.

Dynamic Seasafe Technology ApS shall only be liable for damage to property and personal injuries (product liability) caused as a consequence of defects in the SIM CARD and/or the SIM CARD DATA subscription service delivered to the extent that it is documented that such defect arose due to Dynamic Seasafe Technology ApS’ errors or omissions that could not have been prevented by the Customer’s inspection. Dynamic Seasafe Technology ApS is not in any event liable for any product liability claimed by the Customer or a third party save as covered under Dynamic Seasafe Technology ApS’ Product Liability insurance policy. If Dynamic Seasafe Technology ApS incurs product liability towards a third party, the Customer shall indemnify Dynamic Seasafe Technology ApS to the extent that the liability of Dynamic Seasafe Technology ApS is limited herein.

9. Change of terms

Dynamic Seasafe Technology ApS may discretionary change the terms of the Subscription including on price due to inflation, external costs, unit production costs and changed legislation.

Any change of terms is subject to a notice of three months. If the Customer cannot accept the change of terms, the Customer will have to notify Dynamic Seasafe Technology ApS hereof, whereinafter the Subscription is considered as terminated in accordance with clause 7.

10. Data protectio

When placing an order, the Customer agrees and understands that Dynamic Seasafe Technology ApS stores, processes and use data collected on the Customer for the purposes of processing the order.

If the Customer wish to access the information that Dynamic Seasafe Technology ApS holds concerning the Customer, or wants to make any change hereto, the Customer may contact info@Marine1Alarm.com.

Reference is made to Dynamic Seasafe Technology ApS privacy policy, which can be found below.

11. Force majeure

Dynamic Seasafe Technology ApS is not responsible for delay or hindrance of deliveries that are caused by force majeure events such as (however not limited hereto): bad weather, war, riots, civil disturbances, governmental intervention, fire, strike, lockout, epidemics, pandemics, electronic virus attacks on systems, IT breakdowns, ban on import and export, missing, defective or delayed deliveries from sub-suppliers, shortage of manpower, fuel or transportation, mobilization, currency restrictions, or similar cause that is beyond Dynamic Seasafe Technology ApS’ control and that may have an impact on Dynamic Seasafe Technology ApS’ normal business operations.

If delivery is prevented temporarily by any of the above causes, the time of delivery is postponed for a time equal to the duration of the hindrance, and delivery to the postponed time is considered on time.

If the hindrance is expected to last more than six months, Dynamic Seasafe Technology ApS may at its own choice annul the Subscription.

In the event of a force majeure event, Dynamic Seasafe Technology ApS is not required to reimburse any payments already occurred unless Dynamic Seasafe Technology ApS chooses to annul the Subscription as per above.

12. How to complaint

The Customer is always welcome to contact Dynamic Seasafe Technology ApS ApS on e-mail to info@Marine1Alarm.com in case the Customer has a complaint of different nature than subjected in clauses 5 and 6.

Any complaint can also be sent to the public Danish dispute resolution (in Danish: “Center for Klageløsning, Nævnenes Hus”, Toldboden 2, 8800 Viborg, Denmark), and the online portal at https://kpo.naevneneshus.dk/Public/Home/ChooseLoginProvider?returnUrl=https://kpo.naevneneshus.dk/External.

The EU-Commission’s online complaint portal is relevant for EU citizens, which can be accessed at www.ec.europa.eu/odr.

13. Governing law and jurisdiction

These Subscription Terms and all matters and disputes arising from or connected with these and any Subscriptions shall solely be interpreted in accordance with and be governed by the domestic laws of the Kingdom of Denmark to the exclusion CISG (“United Nations Convention on Contracts for the International Sale of Goods”) and to the exclusion of any conflict of law rules and principles which would refer the matter to another jurisdiction.

Agreements concluded with businesses:
Any dispute, controversy or claim arising out of or relating to these Subscription Terms, termination or invalidity of any related Subscription, shall be settled by the city court of Soenderborg, Denmark as district venue.

Agreements with consumers outside EU:

Any dispute, controversy or claim arising out of or relating to these Subscription Terms, termination or invalidity of any related Subscription, shall be settled by the city court of Soenderborg, Denmark as district venue.

MarineOne Alarm follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services’ analytics. These are not linked to any information that is personally identifiable. It is our environmental obligation to measure concrete steps to reduce implications as much as possible.

We strive to follow our goals during development.

Sourcing of material is carried out in accordance with the European regulations and directives, our company policy and procedures.

By only developing high quality products with focus on long life and low power consumption and thereby long battery life.

Material wastage is minimized and recycling options implemented where possible.

We seek to conserve the use of energy, water, and paper at our location(s).

Our staff have the responsibility to ensure that our company policy is implemented at their workplace, to monitor their own areas of control and take immediate action where faults are found.

When it comes to disposal of used electronics, we strongly recommend to dispose the alarms etc. as electronic waste or return through the WEE arrangement in Europe.
